Private Disability Insurance Claims

Private Disability Insurance Attorneys

You are suffering from a serious and debilitating illness or injury. Fortunately, you have purchased a private disability insurance policy to protect you and your family in this kind of situation. However, will your insurance company fulfill the terms of your policy and pay your claim? What are your options? How do you proceed?

Experienced Legal Representation

The attorneys at Disability Insurance Law Group understand what is at stake when you must file a disability insurance claim. Let our experienced attorneys assist you in dealing with your insurance carrier. Insurance companies often employ unfair and deceptive tactics to deny or delay the payment of such claims. It is essential that you understand what you are facing and make informed decisions based on this knowledge. We guide our clients through the entire process and aggressively fight to assert our clients' rights at every stage.

While our clients come to us at all stages of the process, we encourage you to contact us early on in your claim.

Application and Initial Interview

Filing for benefits can be a difficult, frustrating, and confusing process. An application for benefits can be one of the most important documents in a disability insurance claim. It can help or haunt a claimant throughout the entire claim. These applications are written by insurance companies, to benefit insurance companies. While it may look like a simple form, it is often created to illicit certain information and to discourage a full description of your limitations and restrictions. An application for benefits should never be taken lightly. Insurance companies often misconstrue and take information contained on these forms out of context to deny claims. We guide our clients through the process and thoroughly review all documents before they are submitted to the insurance company.

Insurance companies often require an in-person or telephone interview with a claimant early on in the process. Insurance companies spend an enormous amount of time and energy training their claims examiners and investigators on how to handle a claim. They understand how to ask questions that will illicit information that can later be misconstrued or taken out of context. This frequently provides insurance carriers with the ammunition needed to deny or delay payment of a claim. We do not allow our clients to attend an in-person or telephone interview without our presence. We fully prepare our clients for what they will face prior to the interview and limit the interviewer's ability to ask ambiguous and unfair questions.

Independent Medical Examination

Insurance carriers often require claimants to attend an "Independent" Medical Examination. The examiners are chosen and paid for by the insurance companies. The Attorneys at Disability Insurance Law Group only allow our clients to attend Independent Medical Examinations after careful negotiations about the appropriate physician, the physician's specialty, the tests to be conducted, and the scope of the examination. Typically, we will attend the examination with our client or have it videotaped to insure an unbiased account.

Treating Physicians

Insurance companies will often request that your treating physicians complete Attending Physician Forms. These forms are created by insurance companies, for the benefit of the insurance companies. The forms do not typically fully explain the definition or disability or a claimant's actual occupational requirements. Moreover, insurance companies will often contact your physicians directly, placing unfair and unwarranted restraints on your physician's medical assessment. This could result in your insurance carrier denying or delaying the payment of your claim, based on incomplete information from your treating physicians. The Attorneys at Disability Insurance Law Group collaborate with attending physicians to help them understand our clients' occupational requirements, common insurance company tactics, and the importance of clearly documenting our clients' limitations and restrictions.

The Disability Claim Process

We will assist you at any stage of the process. Many disability insurance claim denials can be prevented by effectively preparing your insurance benefit application. Many denials can be overturned prior to suit, by challenging the insurance company's basis for denial and collecting the right information to support your claim. Further, we will vigorously negotiate with the insurance company to help resolve any dispute regarding your injury. Moreover, if the insurance company refuses to overturn a wrongful denial, we aggressively fight to protect our client's rights at trial.

Business Overhead Expense Policies

Business Overhead Expense Policies are supposed to pay the expenses of your business while you are recovering from a serious illness or injury and cannot work. However, these policies are often written with ambiguous and confusing policy language. Insurance companies often challenge certain expenses as not covered under the policy and refuse to provide the full monthly benefit. The attorneys at Disability Insurance Law Group thoroughly examine our clients' policies and monthly business expenses and aggressively fight to assert our clients' rights under their policies.
